Add a tip for others

If Ontario Works or the Ontario Disability Support Program refused to pay you, or your assistance was cancelled, reduced or put on hold, your benefits changed or you were told you were overpaid, you can appeal to the Social Benefits Tribunal, which can order the office to correct what it finds wrong. First ask the office that decided, in writing, for an internal review within 30 days; if you disagree with the review decision, file the Appeal (Form 1) with the Tribunal within 30 days of receiving it, by email, mail or fax. There is no fee. While you wait you can ask for interim assistance: not everyone qualifies, and if you lose the appeal it is assessed as an overpayment you pay back. A hearing takes about 8 months and the written decision comes within 60 days after it.

Who qualifies

People in Ontario refused Ontario Works or ODSP, or already on it, who disagree with a decision about eligibility, the amount, their benefits, a cancellation, a reduction, a hold or an overpayment. Not for discretionary benefits, employment supports, a refusal to extend the review time, or paying part of your assistance straight to a landlord or utility.

You likely qualify if:

  • Refused Ontario Works or ODSP, or it was cancelled, reduced or put on hold
  • Asked the office for an internal review in writing within 30 days
  • Appeal within 30 days of the review decision
